Can a business be held responsible if an employee or customer gets the coronavirus?

While working from home can seem like the dream setup for many in corporate America, it can also become a curse if you make some rookie mistakes. The question is at the center of a brewing debate across the country as states begin reopening their economies and seek to balance support for businesses with protections for workers and consumers.

"This is a whole new world of legal liability," Stephanie Martz, chief administrative officer and general counsel of the National Retail Federation, told ABC News."It's just potentially the Wild West." Store manager Natalie Hijazi temporarily closes off the entrance to a Pet Fair store inside The Woodlands Mall to help meet occupancy limits, May 5, 2020, in The Woodlands, Texas. The mall reopened Tuesday with increased health and safety measures after stay-at-home orders expired.

"That means if a head of a company said, 'You have to sit next to someone who has all the signs of COVID, without PPE,' you can't sue that boss. That encourages bad bosses to do just that," Senate Minority Leader Chuck Schumer, D-N.Y., said on MSNBC on Monday.

It’s a hoax the politicians who keep states closed are the ones that need to be sued. The hospitals that lie about cause of death are the ones that need to be sued. The media who’s lied about this entire damn thing & Russia (which you’ve run 0 stores on) should be sued truth4U

Most nursing homes are run by slum lords

what we'd you like?

Only ones getting screwed here are employees and customers

Most of the patients who died from Covid19 came from nursing homes and assisted living facilities. Those facilities can be locked down properly with the correct protocols.

Nope you accept the risks by going outside. Just like the possibility of getting hit by a car. Take precautions and go about you life.

Ah. In true American fashion. Who can I sue for liability.

Yes they should. Thousands of lawsuits were filed by workers exposed to asbestos in the lare 60s and early 70s that resulted in many acquiring mesothelioma. Big companies knew of these hazards and continued to expose the workers.

How can you prove where they caught it

I would think , no. They have never been held liable for anyone getting any other illness like flu or cold or pneumonia, etc

Public liabilities by companies insure staff mainly for these reasons so its a case of how & why plus when by who!? & where did it happen at work to get the ball rolling for health & safety so check with your company's insurance policies coverage on virus to be clear as 2 claims

coronavirus Just use this.

Can schools be held accountable for colds and flu for allowing sick kids to go to school?

This right here is one of the many reasons why the U.S. is so fucked up. The question goes beyond retarded & moreover, shows deep ignorance about the way a virus spreads. Honestly, this type of mentality tends to be exhibited by the self-serving, obnoxious cesspool of humanity.

Can a vaccine maker be if they harm someone?

This is a question 🤔 which has no answers yet as this virus can be picked up anywhere? On boxes plastic containers as reported?

How? You can’t be held liable for catching a cold or the flu?

Can causation be proved?

If they’re following heath regulations, no. Absolutely not. You cannot hold employers liable for a virus the world didn’t know about 6 months ago that passes human to human. If theyre in violation of codes, that’s one thing, otherwise leave them alone before we all starve.

There will be a way.

If it was due to negligence they should be held accountable. A sincere attempt to reasonably Mitigate harm is the litmus test.

the business is responsible for it

Proof impossible , We ourselves don't know from where it came? Judgement without certainty no case ,

yep, esp that anglicare branch in sydney. anglicare workers have rarely used basic hygiene & common sense. 😬

all business much from Boeing to Brads have a 'duty of care' for there employees, its a question of how much and how far, hourly testing is questionable, full PPEs isn't

They should sue if they believe they were not protected..

Or the flu

Oh good one.. ouch..

Hey ABC, give me your thoughts on this news that you don't talk about!

How about government, can they be held responsible for any of their mistakes

Yes they are liable. Coronavirus insurance doesn't exist yet. They are 100% liable. Insurance must evolve for that liability.

Yes!

Should be yes

The answer is always... depends if there's money to be made...

It would be hard to prove they actually caught it at that premises

That bad

If I get this thing I am filing like 1000 lawsuits
