Secretary General of the Department of Health Robert Watt has said it was accepted in 2004 that there was a flawed legal basis for charging people with full eligibility for nursing home care in public homes

He told the Oireachtas Committee on Health that the situation was regularised with legislation in 2005, to provide for charges in publicly funded nursing homes and with the establishment of a repayment scheme to refund charges that had been paid before 2005.

Mr Watt said that the consistent position was that it was not the policy intent of Government at that time for public monies to be used in this way. He said it had been the long-standing policy that these people should make some contribution to the cost of their long-term care.
