A North Vancouver developer is suing this women, saying her son agreed to sell him the property that has been in their family for over 80 years.

Doreen Koch, 92, is being sued by a North Vancouver developer who says her son agreed to sell him the 10-acre property that has been in their family for over 80 years.

According to a lawsuit filed in March 2021 in Vancouver Supreme Court, Koch's late son, Collin Jenkins, entered into a contract of purchase and sale, to sell the land to Matthew Timothy Wilson for $475,000.The lawsuit alleges that on July 10, 2020, Wilson entered into a contract of purchase and sale with Koch and Jenkins, to sell the property to Wilson.

Koch admits she executed a power of attorney naming Jenkins, her only child, as her primary attorney. "The fact that this was done behind Doreen's back, without any consultation and without her knowledge, it's what's called a breach of fiduciary duty."Wilson's lawsuit states Koch's property is unique and "no replacement is available."

"I could always come in and just relax when I got here and it was always a stopping place for any of the nephews and nieces or brothers or sisters."

cbcnewsbc my mom had similar thing happen, but ,with help of RCMP in N.S . Escorted from her Home of 60yrs winter 2022 onto the road. this week they wanted to throw her life positions into a garbage bin 685 Monks Head Road, Pomquet. That happened in 6 months and they expect a 100,000.

Happens all to often, people are pressured in signing POA's by families 'just in case * and than use them for their own financial gain. Unless she's been proven incapacitated, by her doctor or a team of doctors, she should recover all her expenses.

cbcnewsbc I feel like this case should've been resolved already. It be unfortunate to find out that the parties involved were prolonging the circumstances intentionally.

Did the son get the money from the developer? I know that I am regularly asked for POA proof and have many obstacles in spite of it. Sounds extremely fishy.

Why is this news? This is a family problem. Whoever owns the house can sell the house to whoever. If ownership is a question then this is where lawyers come in. I can’t judge who is right in a bleeding heart story like this.

Wouldn't the POS son need a power of attorney to do that.
