Under the law, anyone buying agricultural land or property within 10 miles of a military base, installation or designated “critical” infrastructure must sign an affidavit saying they are not prohibited under state law from doing so. The new law specifically prohibits those from China from owning additional property or buying more than a single parcel of two acres that must be at least five miles from a military installation.
“SB 264 upends that balance,” the plaintiffs contend. “Disregarding the federal government’s judgments regarding the appropriate approach to China and other foreign nations, Florida has adopted its own draconian regulation of land purchases.” The groups wrote that it’s also unclear what is “critical” infrastructure or a military “installation” under the new law.
