Federal disability agency lawyers have been accused of invading the privacy of an NDIS funding recipient by requesting a decade’s worth of notes from the woman’s psychiatrist when she challenged a housing decision.
This, along with the failure to provide staff specialising in trauma to assess her case, prompted Camilleri to withdraw her appeal in May 2022, saying she felt she was being “put on trial”, rather than the agency’s decision being the focus of the review. A tribunal spokesperson said it did not comment on individual cases but the NDIA spokesperson said significant reform of the AAT had taken place to ensure a “participant-centred approach”.
The AAT is set to be abolished and replaced by a new administrative body, while the NDIA has introduced pilot programs to reduce the existing AAT caseload. Australian Lawyers Alliance NDIS special interest group chair Tom Ballantyne said the NDIA behaved with an “underlying assumption” that it was entitled to any documentation it saw fit to request.
