National Wills Week sees participating attorneys offering complimentary basic will drafting services. The Western Cape Department of Infrastructure is calling upon all its housing beneficiaries to make the most of this opportunity by having their wills drafted for free between 11 and 15 September.

The transfer of property ownership can often become intricate and emotionally charged when a housing beneficiary passes away, frequently resulting in disputes among family members. To mitigate these challenges and promote clarity, responsibility and empowerment, the Department strongly urges all housing beneficiaries to take advantage of the free will drafting services during National Wills Week.

‘We have many instances where family members request the Department to intervene and direct homeownership following the passing of a housing beneficiary. Residents should be aware that the Department legally cannot get involved in the allocation of a house should the recipient pass, with or without a will. Following the initial handover, a house becomes the personal property and asset of the housing beneficiary.

Without a will in place, your residence and assets are distributed according to the Interstate Succession Act, potentially leading to outcomes that diverge from your preferences. This can result in delays, potential conflicts among family members, and heightened emotional strain during what is already a trying period.Not having control over who inherits your home.Family members may argue or disagree regarding your final wishes.

"They have placed the blame on the informal occupation of abandoned buildings, a phenomenon known as 'hijacking'. They have also blamed immigrant populations who, they say, are the primary residents of such buildings. To solve the problem, they argue, hijacked buildings should be expropriated and redeveloped by the private sector." But Ballard argues that this is a distraction from the urgent work of reducing risks in the living environments of the poor, and reducing the risk of fire more generally. "The rhetoric by politicians and city officials treats the latest tragedy as a freakish problem of hijacked buildings occupied by migrant populations... In Johannesburg, fires are not limited to 'hijacked' buildings. They have also occurred in legally occupied buildings. Furthermore, fires are not a specific risk to inner city populations. "They are a regular occurrence in shack settlements across the city. The use of this tragedy by some politicians to argue in favour of removing hijacked buildings is part of a longstanding pattern of blaming the poor for the conditions and justifying further suffering that they wish to heap on them," he writes.
